California, while being one of the first to legalize marijuana, is using Hemp Politics to make life tough for the fledgling hemp industry.
One of the most confusing parts of California state law is that marijuana is described as cannabis, thus not differentiating it from hemp. The California Department of Public Health (CDPH) released a paper that has decided that CBD, even CBD derived from hemp, cannot be added to any food or beverage products, including animal feed. Under the state’s Sherman Food Drug and Cosmetic Law, it classes these products as adulterated, if there are any hemp-based additives. It did not expressly name cosmetics in the rules, leading law enforcement to believe that it was allowed in cosmetics.
That all changed in January, when cosmetics were also named in the revised CDPH paper. In doing this, it seems the CDPH is just trying to make life more difficult for Californian hemp growers.
